The rental
agreement-generally
We recommend
that you read and observe the terms and conditions carefully. If you do not
observe the terms
and
conditions, you may lose your rights to the holiday home, without being
released from your obligation to
pay to
us.
1. Reservation
We only accepts reservations of head bookers of 21 years and older.
We have the
right, at our sole discretion, to: refuse to confirm any booking, and obtain
the name, age and
gender of
each member of your party before confirming your booking or at any
time.
Within 10
days after reservation you receive the confirmation (also the invoice)
by post.
When you
received the confirmation in writing as well as the invoice, check details
and numbers, please
ensure the
are realistic and related to the entire duration of the Booking.
Prospective
mistakes always needs known in writing at the very latest 10 days after date
of the confirmation
and no later
than the Booking start date.
2. Reservation on long terms
When
you will reserve the cottage in a period where as the prices not ready
published, you will received
the
confirmation within 10 days. As pre-payment we charge 150,--.
You can
cancel the reservation free of charge within 14 days after receiving
the invoice with the exact prices.
3. Prices
The prices and extra cost are mentioned on the sites
www.opvakantieinzeeland.nl or
www.vacationvillas.net
are not
binding. On all prices on the web-sites, changes are reserved. By booking
you will be informed about
the valid
prices, these are binding.
Whilst we reserve the right to increase or decrease prices at any time
before you book, once your booking is
invoiced and confirmed the prices of you holiday is fully guaranteed and
will not be subject to any surcharges.
In
return for this commitment no refunds will be made for exchange rate
movements or cost adjustments that
would
otherwise reduce the holiday cost.
You declares
that you have read and understood the current times and conditions of
rental, when you pays the
first
instalment.
4.Cottage Rent
The rent
is included:
a.
Use of water
b.
Use of energy
c.
Use of the swimmingpool (excl. sauna and whirlpool)
d.
Final cleaning
5. Other facilities
Cost for
using of other facilities and the rent of bikes should be paid before using.
Make use of the other facilities:
a.
Swimmingpool,
daily from 10.00 to 19.00 hour.
b.
Whirpool,
daily from 10.00 to 19.00 hour.
c.
Sauna,
daily from 10.00 to 19.00 hour.
d.
Tennis
court,
daily from
10.00 to 19.00 hour.
6.
Tourist taxes
Prices for the cottage rent are exclusive of tourist taxes. The amount of
these charge is dependant upon the local authority. When determining the
number of persons per booking period, the maximum number of persons staying
for at last one night in the cottage will be deemed valid.
7.
Reservation costs
The rent prices of the cottage are excl.
reservation costs. The reservation costs of 24,50 will be calculating by
booking.
8. Pets
To bring your pet (1 max) you should mention
this at the booking and arrival . The extra cost are 3,-- a day and for
final cleaning because pets 24,50 a week.
Pets are not allowed in the swimmingpool.
Ensure your dog or cat has a current annual vaccination for distemper,
canine hepatitis, leptospirosis and parvo virus, keep your dog on a
leash at all times when outside your cottage, ensure that you take the
dog out outside the private property and does not foul elsewhere. It
is not allowed your dog to lie on furniture or beds and ensure that it is
properly supervised, is not dangerous or causes a nuisance or threat other
people. If we in our sole and reasonable discretion, consider your
dog to be dangerous or to be causing a nuisance, harm or threat to other
people, or to be likely to do so, we may ask you to remove it from the
private property (without refund or compensation) or have it removed to
kennels at your expense. Pets of visitors are not allowed.
9.
Breakage, loss
a.
You must take care of the property and
contents and respect the local rules. If you break or damage
anything in the
accommodation you must inform us immediately.
b.
Our agreement with you binds you and all
members of your party including children and any day
visitors. It is
your responsibility to ensure that you and your members of your party are
aware of and
accept the whole of
this agreement and the obligations in it.
c.
You and your members of the party will
be liable for the cost of repairs and replacements and must be
compensate for the
damage.
10. Guarantee/deposit.
a.
For the cottage a deposit of 150,-- is
paid before the key is collected. The deposit acts for the
cottage being
passed on in a clean and presentable state.
b.
The deposit will be returned, minus
charges, on condition that the cottage is passed on in a clean and
presentable state,
without damages and that you does not owe further amounts to us. The
tenants
liability for
charges and damages is maintained even through the value exceeds the amount
paid in
deposit/on-account.
11.
Payment
a.
Within 10 days after reservation you
should pay 30% of the rental with a minimum of 150,--
The balance of the price
of your holiday is due at last 10 weeks before arrival date.
b.
At reservations made within 10 weeks
before the date of arrival, the total amount should be paid
within 10 days.
c.
If the balance is not paid in time, we
reserve the right to cancel your holiday, retain your deposit, and
apply the cancellation
charges.
d.
If the deposit as say by a and b, is not
received by the date shown on the invoice, we reserve the right
to cancel the booking and
book the cottage for other guests.
12.
Cancellations
If you have to cancel you holiday the
following cancellation charges will be payable:
a.
Cancellations received 43 days or more
before arrival date = 30% of the rental (minimum of 150,-- )
b.
Cancellations received 42 day or
less before arrival date=100% of the rental
c.
Similarly if you have to cut short your
holiday no refund can be made for the days unused
d.
Payment mentioned (with) a and b must be
14 days after receiving invoice be done.
e.
Cancellation can only be guaranteed if
confirmed in writing by us.
13. Arrival and departure times
You should arrive between 15.00 and 19.00
hours on the day of commencement of your booking and vacate before 10.00
hours on de day of departure .
You must contact us if you are delayed. If you are unable to take
occupation on the day and time reserved due to delays, illness, personal
reasons etc. no refund can be made. Similarly if you have to cut short your
holiday no refund can be made for the days unused.
14.
Regulations
a.
All guests should adhere to the
behaviour regulations we decided. Please note that the local regulations
and standards apply
to the local services and not those of the UK!
b.
Occupation of the property is strictly
limited to the number of people indicated on the invoice. We have
the right to refuse
entry to extra people.
c.
You must leave the house in good order
and wash and put away all kitchen utensils, empty fridge and
dustbin before
departure.
d.
The private property is accessible, with
the exception of the orchard and the garden behind the county
house.
e.
It is not allowed to enter the indoor
swimming pool with shoes, to play in the swimming pool with balls
or other (hard)
toys. To use the linen and other product are present in the
swimming pool is also not
allowed .
f.
The use of sauna, whirlpool or
tennis court and the rent of bicycles must be known before using it.
g.
We can adjust the opening times of the
facilities
h.
You allow necessary maintenance to be
executed without compensation .
i.
Should the tenant or accompanying
persons behave in an inappropriate and unacceptable manner, we
reserve the
right to annul the rental agreement immediately and without warning. In such
a situation,
we have no
obligation to repay al or part of the rental price.
15.
Force majeure and change
a.
If the accommodation is not
available by superior forces or other reasons we may offer another period
of the same value (if
available) .
b.
If we discover any changes after you
have confirmed your booking, we will of course advise you
immediately. We will
offer you the option of accepting the charge or another period the
same value
(if available) or a full refund
of all monies paid, but no further compensation.
c.
You and your members of the party are
not freed from the responsibility of payment due the personal
circumstances of force majeure
(war, strike, block catastrophe of nature, etc.) preventing the tenant
form exercising the use as per
rental agreement.
d.
We can immediately annul the rental
agreement if the cottage is not available due to force majeure.
16.
Responsibility
a.
We do not accept any responsibility
for theft, loss or damage to belongings or persons during or due
to a stay at
our cottage . We are also not responsible if the accommodation do not come
up to the
expectations.
We are not responsible for damage or injury due to a stay on the site of us
the facilities
b.
We are not liable in any
circumstances for any consequential of economic loss arising out of any
contract
c.
We cannot accept responsibility for any
break in services, such as gas, electricity and water, or any
failure
attributable to your own fault or party member or the actions of third
parties unconnected with
the provision of
services or force majeur reasons
d.
You and your members of the party has a
responsibility to treat the cottage with respect, in so far as the
tenant is
responsible for any damages which he/she or any member of his/her party
causes.
e.
You are severally liable for all the
loss and or damage to the rented accommodation, the rented period
and other possessions of
us. It is not relevant if the damage was caused by you or someone with
your
permission to enter the
Country estate.
f.
At wrong use, not well left behind,
included abnormal filthiness of the accommodation, extra costs can
be charged, which you are
obligated to pay. These costs must be paid immediately or cleared with
the
guarantee.
17.Complaints
We do hope you enjoy your holiday. In spite of
the care and efforts of us, it could happened that you have a complaint. If
you should have a problem during your holiday you must inform us
immediately we will endeavour to put things right.
18. Day-Visitors
If as tenant you wish to received visitors, you need prior
permission. For this purpose fixed rate will be charge a day.
19. Pricelist
This Terms and Conditions also applies to the
current price list.
20. General
This Terms & Conditions are apply to all
reservations , direct or indirect.
This contract is made on the terms of these booking conditions which are
governed by
Dutch Law and both parties shall submit to the jurisdiction of Dutch Courts
at all times.
